Long Island Birth Injury Attorney

An injury at birth can be devastating to both the child and the family. The injury can often leave parents asking questions about what went wrong  and why . Sadly, children are born every day on Long Island and across New York State with birth injuries  caused by negligent care at the time of labor and delivery. Medical providers have an obligation to use reasonable care when caring for their patients. Two common birth injuries include Cerebral Palsy (brain injury) and Erbs Palsy (brachial plexus injury).

Cerebral Palsy is permanent  brain damage, which can occur during labor and delivery. Symptoms of cerebral palsy include mental retardation; speech, hearing or sight impairment; unusual awareness and sensation; problems walking; seizures; involuntary movement; and muscle spasm or tightness.

When a medical provider fails to plan for and address complications during pregnancy and labor, the baby can be deprived of oxygen. This lack of oxygen can destroy brain tissue, resulting in Cerebral  Palsy. Children with Cerebral Palsy often need life long care. 

Erbs Palsy is a major nerve injury, which may be permanent . The brachial plexus is a large system of nerves which runs down the spinal column to the muscles in the shoulders and arms.  If a baby's shoulders become lodged behind the mother's pubic bone during birth, there are accepted maneuvers designed to allow a prompt and safe delivery. When a doctor does not adequately plan for and provide a safe delivery, excessive force can be applied while pulling on the baby's head, and the delicate nerves in the neck may  be stretched and torn, resulting in Erbs Palsy. Symptoms of Erbs Palsy include complete or partial paralysis in a child's arm, limited or no movement in a hand and/or fingers, or loss of feeling in the hands and/or fingers. Children with Erb's Palsy often require therapy and may need surgical repair in an attempt to restore function to the affected arm.
